THE FQ PRIVACY POLICY
This Privacy Policy (“Policy”) pertains to visitors and users of the official The Female Quotient, LLC (“FQ”) site at thefemalequotient.com and its related web pages, applications, platforms, products, and services offered therein (the “Site”). It does not govern offline activities. It also does not govern activities on third-party sites linked to the Site. By using the Site, you the user (“you”) agree to be bound by the Policy. If you do not agree, please discontinue use of the Site immediately.
To effectively advance FQ’s advocacy of equality in the workplace, some necessary tracking and data collection of the Site’s visitors and users does occur. The what, how and when of these practices are explained below. As FQ’s practices evolve, FQ may update the Policy and will alert you that changes have been made by indicating the date it was last updated at the bottom of the Policy. FQ also encourages you to periodically review this Policy. By continuing to use the Site after any changes are made, you accept these changes.
What Types of Data Does FQ Collect?
First, thank you for visiting FQ’s Site, and please know that FQ values your privacy. FQ retains personal information only for the period necessary to fulfill the purposes described below, unless a longer retention period is allowed by law. Typically, data containing any personally identifiable information comes directly and voluntarily from you. Data that contains your “personal information” refers to information that directly identifies you or information that can be used to personally identify you. This may include:
- Information and Content Provided Directly and Voluntarily by the Site’s User: FQ collects the information and content that you voluntarily provide, at your sole discretion, when you choose to use the Site, access its features, make purchases, and join FQ’s public online forum for discussing important socioeconomic issues. For instance, data that you may choose to provide and that your name, contact information (address, email, and phone number), employer, title, industry, interests, gender, photos, videos, messages, usage data, such as page views and browsing behavior, and financial information (credit card number, billing address, etc.), where applicable (collectively, the “Data”). FQ may also collect some personal information passively, while you are visiting or interacting with the Site. FQ refers to this collection practice as “passive,” because it is automated and collected just by your visit to and browsing of the Site. Generally, this data collection practice does not include collection of information identifying you personally, however there may be times when it is passively collected. Rather, it collects and aggregates data on user and visitor activity on the Site (“Aggregated Information”). The passive data collection practices FQ may use consist of:
- Data Collected by Cookies, Web Beacons, and Similar Technologies. FQ may use cookies, web beacons, or other similar technologies to improve the overall performance of its Site and the quality of your experience on the Site. A cookie is a small piece of data stored on your device that remembers information about your activity. Similarly, a web beacon is a small file stored online that monitors your usage of the Site. Cookies and web beacons work together to enable the Site to personalize your visit and make it more user friendly, for instance, by allowing the Site to remember your preferred settings and activities so you won’t need to resubmit certain information. Check your browser settings to determine if and where cookies are stored and whether and how they may be deleted.
- Data Passed Along from Third-Party Referring Sites. FQ’s Site may also collect information from third-party referring sites. This means from the website, URL, or web browser from which you were directed to FQ’s Site. When you reach FQ’s Site from a third-party site, that third-party referring site may pass along to FQ’s server information it collected from your use of its site, such as your “IP address” (a number used by computers online to identify your computer), the type of web browser, operating system or platform you use, the internet address and domain of the site you left to visit the Site, and when and how many times you were referred by this third-party to the Site.
- Data Collected from Analytics Tools. FQ may utilize Google Analytics or other third-party data analytics tools to identify and track how its users engage with the Site. Such analytics tools utilize cookies and other similar technologies, described more fully above, to collect information and trends on how people engage with the Site. For example, they might collect and summarize information on the number of visitors to the Site, how many visitors are new or returning, how long visitors stay on the Site, and which webpages of the Site get the most online traffic. This, in turn, allows FQ to evaluate and improve the Site’s features.
How does FQ Collect this Data?
FQ collects the Data through third-party services. Currently, FQ uses © Splash, © HubSpot, Inc., and @ Beehiiv, Inc. to collect the Data. These sites’ privacy policies can be found at: https://www.cvent.com/en/cvent-global-privacy-policy, https://legal.hubspot.com/privacy-policy, and https://www.beehiiv.com/, respectively. These sites collect the Data, store the Data, and then allow FQ access to the Data. To request disclosure or deletion of Data collected and saved by these sites, please submit a written request to contact@thefq.com (to the attention of: “Data Privacy Team”) or to anyone of these sites as laid out in their respective privacy policies.
Why does FQ Collect this Data?
The mission of FQ’s Site is to facilitate a global, online, public forum for activism on the issue of gender equality and related socioeconomic matters. FQ may also use the Data to share events, newsletters, communications, and other possible interests with you. FQ’s Site is designed to help users connect with others and to publicly share their own experiences, related information, and news. All the data collected, directly or passively, is lawful and serves an important purpose. FQ’s users decide what content and personal information they want to share in a public forum. All the data FQ collects is used to benefit FQ’s users, improve the Site, and promote its underlying mission. In sum, FQ uses the collected data to: communicate with you, fulfill your requests, provide you with requested services, promote the Site, process transactions, facilitate your ease of use and FQ’s administration and operation of the Site, provide you with information you request or information that FQ thinks will be of interest to you, respond to your submissions, monitor and analyze site usage and trends, and personalize and improve the Site based on FQ’s users’ preferences and analysis of site usage and trends.
How is this Data Shared?
Sometimes FQ needs to rely on third-party partners and vendors to help us operate and improve the Site. FQ shares its data with them on an as-needed basis. To be clear, FQ does not sell any of its data, especially data containing your personal information, to anyone. Data may be shared with analytics vendors. FQ may need to provide information to vendors and service providers who support its business and the functionality of its Site, such as by providing technical infrastructure services and facilitating payment processing. Shipping Couriers may receive necessary personal information in order to fulfill product orders or any other shipments. FQ might be forced to share data with law enforcement in response to legal requests or court orders. FQ expressly reserves the right to transfer any data to a successor in interest that acquires rights to that information because of a sale. Finally, if you choose to share your information publicly, it is no longer in FQ’s control.
The Site is also connected in a variety of ways to content on other platforms. For instance, FQ provides links to content on social media platforms such as Facebook, Instagram, YouTube, LinkedIn, and Twitter, and to content on other sites, such as news and press release sites. The Site also features embedded media, such as videos, that may be hosted on these other platforms but viewable from links on the Site. The providers of such external content might place their own cookies on your device or otherwise collect user data, which is subject to their, not FQ’s, respective online privacy policy.
How is the Data Protected?
Any data FQ may have that contains your personal information is stored on third-party servers and not publicly accessible (unless, as discussed above, you have chosen to publicly disclose information about yourself). FQ makes no representations or warranties regarding the security measures of the third-party servers it uses. Additionally, all data transmitted to and from FQ’s website, when and where applicable, is encrypted using industry standard security measures. FQ stores its data for as long as necessary for the purpose for which it originally collected it. FQ may retain certain data for legitimate business purposes or as required by law. FQ does not store any of the Data itself.
FQ is based in the United States, and it processes and stores its data in the United States. It is possible that FQ’s service providers may process, transfer, access, store, or receive data from foreign jurisdictions with different data protection laws. FQ recommends you consult the data privacy protection laws in your home jurisdiction if you are not from the United States. In certain circumstances, local data protection laws (such as the “GDPR”) may give you rights with respect to personal information if you are located in or are a resident of that country, state, or territory (including if you are located in the EU/EEA).
FQ will take all reasonable steps and measures to ensure that the Data it receives will have an adequate level of protection to prevent loss, misuse and unauthorized access, disclosure, alteration, and destruction. Please be aware, however, that despite FQ’s best efforts, no security measures are perfect or impenetrable, and no method of data transmission can be guaranteed against any interception or other type of misuse. To protect the confidentiality of personal information, you also have a duty to keep any passwords confidential and actively prevent unauthorized use of your devices and site log-ins.
As stated, FQ does not retain the Data itself. FQ uses third-party service providers for the processing and storage of the Data. These third-party service providers will retain the Data subject to their respective privacy policies. At your request, FQ will contact its third-party service providers to request the deletion of your Data.
If you are located in the European Union or the United Kingdom, this section applies to you.
The General Data Protection Regulation (GDPR) and UK GDPR requires FQ to explain the valid legal bases it relies on in order to process your Data. As such, FQ may rely on the following legal bases to process your personal information:
- Consent. FQ processes your information if you have given it permission (i.e., consent) to use your personal information for a specific purpose. You can withdraw your consent at any time.
- Performance of a Contract. FQ may process your Data when it believes it is necessary to fulfill FQ’s contractual obligations to you.
- Legitimate Interests. FQ may process your Data when it believes it is reasonably necessary to achieve its legitimate business interests and those interests do not outweigh your interests and fundamental rights and freedoms. For example, FQ may process your Data for some of the purposes described in order to:
- Send users information about FQ’s events, newsletters, and other services;
- Analyze how FQ’s services are used so it can improve them to engage and retain users;
- Support FQ’s marketing activities; and
- Any other allowed legitimate business purpose.
- Legal Obligations. FQ may process your information where it believes it is necessary for compliance with its legal obligations, such as to cooperate with a law enforcement body or regulatory agency, exercise or defend its legal rights, or disclose your Data as evidence in litigation in which it is involved.
- Vital Interests. FQ may process your information where it believes it is necessary to protect your vital interests or the vital interests of a third party, such as situations involving potential threats to the safety of any person.
In legal terms, FQ may generally be the “data controller” under European data protection laws of the personal information described in this privacy notice, since it determines the means and/or purposes of the data processing FQ performs. This privacy notice does not apply to the personal information FQ processes as a “data processor” on behalf of its customers. In those situations, the customer that FQ provides services to and with whom it has entered into a data processing agreement is the “data controller” responsible for your Data, and FQ merely processes your information on their behalf in accordance with your instructions. If you want to know more about FQ’s third-party service providers’ privacy practices, you should read their privacy policies and direct any questions you have to them.
Under GDPR/UK GDPR, you also have rights to access, rectify, erase, restrict processing, object to processing, and request portability of your personal information. You may exercise these rights by contacting FQ’s Data Privacy Team at contact@thefq.com.
Notice to California Residents of California Consumer Privacy Act (CCPA)
This California Privacy Notice is for California residents and supplements this Policy. Under the CCPA, you have the following rights:
- Right to Know: You have the right to request disclosure of any personal information FQ may have collected;
- Right to Request Deletion: You have the right to request deletion of any personal information FQ may have collected;
- Right to Non-Discrimination: FQ will not discriminate against you for exercising any of these rights.
To request disclosure or deletion of any personal information you believe may have been collected and saved by us, please submit a written request to contact@thefq.com (to the attention of: “Data Privacy Team”). Note that, to protect the privacy rights of FQ’s users, FQ will need to verify your identity before processing your request.
California residents also have the right to correct inaccurate personal information, opt-out of the sale or sharing of personal information, and limit the use of sensitive personal information.
Children’s Privacy
The Site is intended for professionals and/or individuals over eighteen (18) years of age. FQ does not knowingly collect any personal information from children under the age of eighteen (18).
Governing Law
Any dispute or controversy relating to this Policy shall be resolved under the laws of the State of California, including all matters of construction, validity, performance, and enforcement, without giving effect to the principles of conflict of laws, and any action brought by any party hereto shall be brought within the State of California, County of Los Angeles, in the state or federal courts located in Los Angeles, California.
Procedure for Updating Your Preferences
Contingent on the applicable data protection laws that apply to you, you may request changes to your preferences by submitting a request by email to the attention of “Data Privacy Team” at contact@thefq.com. FQ will provide notice of any updates to this Policy either by email or by posting notice on its Site.
